Terms of Use for Gift It

Who these terms are with

Gift It ("the app") is published by CWTI Ltd, 24 Tax Suite 137b Westlink House 981 Great West Road, Brentford, TW8 9DN, United Kingdom ("we", "us"). By installing or using the app you accept these terms.

These terms cover the app itself. The store you installed from — Google Play or the App Store — has its own terms with you, and those govern the payment, the refund and the store account. On iOS, the app is also licensed under Apple's Licensed Application End User License Agreement.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for as long as you comply with these terms and with the rules of the store you installed from.

You may not sell, rent or redistribute the app, remove its notices, or attempt to reverse engineer, decompile or modify it, except where the law gives you that right regardless of what a contract says.

What the app does

Gift It keeps the people you care about in one list, remembers their birthdays and occasions, and holds the gift ideas you have for them so they are there when you need them. It can send you a reminder before the date. You can also keep a wishlist of gifts for yourself.

Your account and your content

Using the app needs an account. You can sign in with an email address, with Google, or — on Apple devices — with Sign in with Apple.

Your friends, your gift ideas and your wishlist are stored on our servers so they survive a lost phone and follow you to a new one. The Privacy Policy explains what is stored, why, and which third parties are involved.

What you write in the app is yours. You are responsible for it, including for the details you record about other people — names, dates and notes — which you should only enter if it is reasonable for you to hold them. Do not upload anything unlawful, and do not upload an image you have no right to use.

Free use, Pro and advertising

The app carries no advertising. Nothing in it is funded by showing you an advertisement.

The free version is limited by use, not by time. It lets you keep your first friend and your first gift for a friend. Adding a second of either needs Pro. Wishlist items — gifts you record for yourself — do not count towards that limit and are not capped. Turning a wishlist item into a gift for a friend makes it one, so it uses the same free allowance as a gift you create for a friend.

Pro removes those limits. It is sold as a subscription, monthly or yearly. The price and the currency shown on the purchase screen at the moment you buy are the ones that apply; prices differ by country and can change for future purchases. There is no free trial. The free version does not expire; it stays free for as long as you use it within the limits above.

Where the app offers a one-time lifetime unlock, it is a single payment that never renews. "Lifetime" means the working life of the app on the store where you bought it. It is not a promise that the app will be published forever.

Billing and renewal

Payment is taken by the store, not by us. A subscription renews at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged for renewal within the 24 hours before the period ends. We never see or hold your card details.

Cancelling

Cancel at any time in your store account: Google Play → Payments and subscriptions → Subscriptions, or App Store → your name → Subscriptions. Deleting the app does not cancel a subscription. Cancelling stops the next renewal; the period you have paid for runs to its end.

Refunds

Refunds are handled by the store under its own policy, because the store took the payment. If you believe something went wrong with a purchase, write to us and we will help you put the request to the right place.

Restoring a purchase

Use "Restore purchase" in the app to bring Pro back after a reinstall or on a new device signed in to the same store account. A purchase made on one store cannot be restored on the other.

Reminders

Reminders are a convenience, not a guarantee. A notification can be delayed or dropped by your device, your operating system or your network settings, and we cannot promise one will arrive. Do not rely on the app alone for a date that matters to you.

Acceptable use

Do not use the app unlawfully, do not interfere with it or with our servers, and do not try to obtain Pro without paying for it.

Changes to the app and to these terms

We may change, suspend or discontinue any part of the app. We may update these terms; the updated version is posted on this page with a new update date. If a change matters to a purchase you have already made, the terms in force when you bought apply to that purchase.

No warranty

The app is provided "as is" and "as available". To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or suited to a particular purpose.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for a missed occasion. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every right your local consumer law gives you, and nothing here takes those away.

Governing law

These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you also keep the protection of the mandatory law of the country where you live.
