Terms of Use for StreakUp

Who these terms are with
StreakUp ("the app", formerly Push-Up Tracker) is published by CWTI Ltd, 24 Tax Suite 137b Westlink House 981 Great West Road, Brentford, TW8 9DN, United Kingdom ("we", "us"). By installing or using the app you accept these terms.
These terms cover the app itself. The store you installed from — Google Play or the App Store — has its own terms with you, and those govern the payment, the refund and the store account. On iOS, the app is also licensed under Apple's Licensed Application End User License Agreement.
Your licence
We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for as long as you comply with these terms and with the rules of the store you installed from.
You may not sell, rent or redistribute the app, remove its notices, or attempt to reverse engineer, decompile or modify it, except where the law gives you that right regardless of what a contract says.
What the app does
StreakUp helps you build a daily exercise habit. You log your push-ups and other exercises, and the app keeps your streak, your history and your personal records. Streak shields can protect a streak on a day you miss. The app can remind you to train, and it can show your streak in a home-screen widget.
Health notice
StreakUp is a habit tracker. It is not medical advice, and it is not a training programme made for you. Talk to a doctor before you start to exercise if you have a health condition, an injury, or any doubt about whether exercise is safe for you. Stop if you feel pain, dizziness or shortness of breath. You exercise at your own risk, and you decide how much to do.
Your account and your data
You can start as a guest. You can sign in with Google, with Apple, or with an email address to keep your data across devices.
Your activity is stored on our servers so it survives a lost phone and follows you to a new one. The Privacy Policy explains what is stored, why, and which third parties are involved. You can delete your account and the data on our server from the Profile screen in the app. If an earlier version of the app stored your history with another provider, the Privacy Policy explains how to have that older copy deleted.
Free use, StreakUp Plus and advertising
The free version of the app shows advertising. Some extras in the free version, such as earning a streak shield or restoring yesterday's missed day, need you to watch a short video ad.
StreakUp Plus is an optional subscription. It removes the ads, lets you earn streak shields without an ad and up to 5 of them instead of 2, lets you restore yesterday's missed day without an ad, and keeps Personal Records always unlocked. If Plus ends, you keep the shields you already hold and can use them, but you earn new ones only while you hold fewer than 2.
Plus is sold as a subscription, monthly or yearly. The price and the currency shown on the purchase screen at the moment you buy are the ones that apply; prices differ by country and can change for future purchases. The free version does not expire; it stays free for as long as you use it.
Free trial
The yearly plan can include a 7-day free trial, for users the store considers eligible. The purchase screen shows whether you are offered one. Unless you cancel at least 24 hours before the trial ends, the yearly subscription starts at the end of the trial and you are charged the yearly price.
Billing and renewal
Payment is taken by the store, not by us. A subscription renews at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged for renewal within the 24 hours before the period ends. We never see or hold your card details.
Cancelling
Cancel at any time in your store account: Google Play → Payments and subscriptions → Subscriptions, or App Store → your name → Subscriptions. Deleting the app, or deleting your StreakUp account, does not cancel a subscription. Cancelling stops the next renewal; the period you have paid for runs to its end.
Refunds
Refunds are handled by the store under its own policy, because the store took the payment. If you believe something went wrong with a purchase, write to us and we will help you put the request to the right place.
Restoring a purchase
Plus belongs to the StreakUp account you used when you bought it. Sign in to that account on another device, on either store, and Plus is active there too. Use "Restore purchases" in the app to bring Plus back after a reinstall or on a new device signed in to the same store account; it asks only the store of the device you use. You manage and cancel the subscription in the store where you bought it.
Reminders
Reminders are a convenience, not a guarantee. A notification can be delayed or dropped by your device, your operating system or your network settings, and we cannot promise one will arrive. A missed reminder does not entitle you to a restored streak.
Acceptable use
Do not use the app unlawfully, do not interfere with it or with our servers, and do not try to obtain Plus without paying for it.
Changes to the app and to these terms
We may change, suspend or discontinue any part of the app. We may update these terms; the updated version is posted on this page with a new update date. If a change matters to a purchase you have already made, the terms in force when you bought apply to that purchase.
No warranty
The app is provided "as is" and "as available". To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or suited to a particular purpose.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, for a lost streak, or for an injury that results from exercise you chose to do. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every right your local consumer law gives you, and nothing here takes those away.
Governing law
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you also keep the protection of the mandatory law of the country where you live.
